CNN —Former President Donald Trump and several of his co-defendants in the Georgia election subversion case are appealing a judge’s ruling that let Fulton County District Attorney Fani Willis remain on the election subversion case. The defense attorneys on Friday asked the Georgia Court of Appeals to overturn Judge Scott McAfee’s initial decision that allowed Willis and her office continue to pursue the case but only if Nathan Wade, the special prosecutor with whom she had a romantic relationship, resigned. While Wade has since left the case, defense attorneys still want the appellate court to disqualify the entire Fulton County DA’s office. “DA Willis has covered herself and her office in scandal and disrepute, as she has squandered her credibility and repeatedly and flagrantly violated the heightened ethical standards demanded of her position,” the appeal states. CNN —Fulton County District Attorney Fani Willis can stay on and prosecute the Georgia 2020 election interference racketeering case against former President Donald Trump and 14 of his co-defendants, Judge Scott McAfee ruled Friday, but only if she removes the special prosecutor with whom she engaged in a romantic relationship. CNN has reached out to the district attorney’s office regarding the next steps in the case. Wilis chose to dedicate much of her energy on what she believed was the most important case: prosecuting Trump for his attempts to steal the Georgia election in 2020. CNN —A Georgia state Senate committee investigating allegations of wrongdoing by the Fulton County District Attorney Fani Willis heard more than three hours of testimony from defense attorney Ashleigh Merchant that largely went unchallenged by the mostly Republican committee and offered little to no new information about the claims. Merchant is representing one of Donald Trump’s co-defendants in the sprawling 2020 Georgia election interference racketeering case and is seeking to have Willis, a Democrat, removed from the case, possibly endangering the entire prosecution. It’s unclear if another prosecutor in Georgia would even be inclined to take up the case from Willis, given its political and legal challenges. CNN —The judge presiding over the Georgia election subversion case against Donald Trump and several co-defendants said Monday that the district attorney who brought the case could be disqualified if she financially benefitted from a personal relationship with her lead prosecutor on the case. Trump and his co-defendants are also seeking to get the entire case dismissed. “The state has admitted a relationship existed,” McAfee said. “The issues at point here are whether a relationship existed, whether that relationship was romantic or non-romantic in nature, when it formed and whether it continues,” McAfee said. While McAfee said Willis may not be the first witness called on Thursday, he did not rule out the possibility of Willis taking the stand.

CNN —A medical examiner on Tuesday released the manner of death for a baby whose mother accused a Georgia hospital and others of decapitating during delivery, ruling it a homicide. The Clayton County, Georgia Medical Examiner’s office said the baby died from a broken neck and the baby’s head was detached, according to a news release shared with CNN. Ross went into labor on July 9 and her doctor attempted to deliver the baby using various methods, including “applying traction to the baby’s head,” the lawsuit says. Ross says the doctor “grossly” and “negligently applied excessive traction” on her baby’s head and neck, the complaint says. Still, a source familiar with the thinking inside the DA’s office told CNN they would be “mystified” if it succeeds in removing her. “I think a lot of what I’ve read is more of a distraction and not legally substantive,” James told CNN in a sit-down interview. This is the first time Trump’s attorneys will appear in court in the Fulton County case, though their client won’t be with them. Trump hasn’t yet been in the Atlanta courthouse – he previously waived his right to an arraignment hearing – though he was processed at the Fulton County jail in late August. Atlanta CNN —The judge presiding over Donald Trump’s racketeering case over efforts to overturn the 2020 election in Georgia has issued a protective order on sensitive discovery materials in the case. In his order, Fulton County Superior Court Judge Scott McAfee wrote that a protective order was necessary in part because providing “parties the unfettered ability to share pretrial materials with the public undermines” the process. According to Thursday’s order, it will be up to the Fulton County district attorney’s office to specifically designate discovery materials that it deems sensitive. Additionally, the order says defense attorneys will be able to store the materials in good faith. Fulton County prosecutors had suggested that defense attorneys would have to physically come to the DA’s office to view the materials.

The Fulton County district attorney’s office did not immediately respond to CNN’s request for comment about the emergency protective order or leaked videos. The videos provide some new details about efforts by those close to Trump to reverse the election in his favor. (CNN) – Fulton County prosecutors have discussed potential plea deals with at least six additional co-defendants charged alongside Donald Trump for attempting to subvert the 2020 presidential election, multiple sources tell CNN. Pro-Trump lawyer Robert Cheeley is among those who have been offered a plea deal in the Georgia case but, according to his lawyer, turned it down. A source with knowledge of the Fulton County DA’s strategy tells CNN that it would be open to discussing plea deals with anyone, but there is little room for compromise when it comes to the charges against Trump. To be clear, there is no indication that prosecutors or Trump’s legal team are interested in discussing a plea deal. John Eastman, who is also considered one of Trump’s most high-profile co-defendants, has not been offered a plea deal either, his lawyer told CNN.
